1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the RCRM platform operated by AGV.VIZION ("we," "us," or "our"), including our website, applications, and all related services (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Description of Service
RCRM is a customer relationship management platform designed for wedding and event photographers. The Service includes lead management, client portals, booking and pipeline tools, contract generation, payment tracking, email and SMS communication, calendar integration, gallery management, and related features.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when possible.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to use the Service
- One person or legal entity may maintain no more than one free account
- You are responsible for all activity that occurs under your account
- You must notify us immediately at alex@agvvizion.org if you suspect unauthorized access to your account
4. User Responsibilities
By using the Service, you agree to:
- Use the Service only for lawful purposes and in compliance with all applicable laws
- Obtain proper consent from your clients before storing their personal data on the platform
- Not upload content that is illegal, harmful, threatening, abusive, or infringing
- Not attempt to gain unauthorized access to any part of the Service
- Not reverse engineer, decompile, or disassemble any part of the Service
- Not use the Service to send unsolicited messages (spam)
- Not use automated systems (bots, scrapers) to access the Service without our written permission
- Comply with Stripe's terms of service when using payment features
5. Payment Terms
- All payments are processed securely through Stripe. By making a payment, you also agree to Stripe's Terms of Service
- Subscription fees are billed in advance on a recurring basis (monthly or annually)
- All fees are non-refundable except where required by law or as explicitly stated in a separate agreement
- We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period
- Failure to pay may result in suspension or termination of your account
- You are responsible for all applicable taxes related to your use of the Service
6. Intellectual Property
Our Property
The Service, including its design, code, features, branding, and documentation, is owned by AGV.VIZION and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
Your Content
You retain ownership of all content you upload to the Service (photos, text, client data, documents). By uploading content, you grant us a limited, non-exclusive license to store, display, and process that content solely for the purpose of providing the Service to you. We will never use your content for marketing or share it with third parties without your explicit consent.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.
As a user who stores client data on the platform, you acknowledge that you are a data controller for your clients' data and are responsible for complying with applicable data protection laws (including GDPR and CCPA where applicable).
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, and unplanned outages may occur. We are not liable for any loss or damage resulting from service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, AGV.VIZION and its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
Our total cumulative liability to you for all claims relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Indemnification
You agree to indemnify, defend, and hold harmless AGV.VIZION from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
- You may cancel your account at any time from your account settings or by contacting us
- We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in activity that harms the Service or other users
- Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days to allow for data export, after which it will be permanently deleted
- Sections on Intellectual Property, Limitation of Liability, Indemnification, and Governing Law survive termination
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in California.
13. Changes to These Terms
We reserve the right to update these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
